Fatal police shooting of Antonio Blackbear declared justified by Denver DA

Denver District Attorney Beth McCann concluded Monday that the fatal shooting of 41-year-old Antonio Blackbear by police officers in September was legally justified.

“This was a clear cut situation,” McCann said. “Mr. Blackbear was threatening lives as these officers responded to several community members’ calls for help.”

McCann said no criminal charges are warranted against the officers involved.

On Sept. 9, officers Kyle Saunier and Lynnea Vento responded to Inca Street and West Seventh Avenue at 5:19 p.m. after numerous people called 911 to report a man walking around the area with a gun.

The man was later identified as Blackbear and the gun he carried was later determined to be a replica airsoft pistol.

When the officers arrived, Blackbear was pointing the gun at the occupants of a vehicle, telling them to get out, according to McCann’s decision letter. The occupants fled the vehicle when Blackbear turned his attention to a passing truck.

The officers yelled for Blackbear to show his hands, at which point Blackbear pointed the gun at the officers and walked toward them.

Both officers fired. Vento fired four times and Saunier fired nine times, according to the decision letter.

One of Saunier’s shots hit Blackbear in the head. Blackbear was taken to a hospital but died of his injuries hours later at 12:07 a.m.

“When Mr. Blackbear saw the officers, he pointed what convincingly appeared to be a Glock handgun directly at these officers,” McCann said. “They acted in self-defense and in defense of others.”

Blackbear’s death sparked candlelight vigils and protests throughout Denver. At the time, Blackbear was one of three people fatally shot by Denver police within one week.

McCann will hold a virtual community meeting to discuss her conclusion on Nov. 30 from 5:30 to 6:30 p.m. The public can join the Microsoft Teams meeting.
