Deadly shooting was sparked by demand for free food, police say

A man has been arrested and is facing a first-degree murder charge in connection with a shooting that started with a demand for free food Thursday afternoon in west Denver.

Rafael Acosta-Hernandez, 24, was arrested after the shooting that occurred around 12:18 p.m. Thursday in the 2600 block of Zuni Street, near the intersection with North Speer Boulevard.

According to a probable cause (PC) statement from Denver Police for his arrest, Acosta-Hernandez got into an argument with the victim that escalated to the shooting. It says Acosta-Hernandez was outside the pickup truck he used for selling food and drinks when the victim walked up and demanded free food and salsa. When Acosta-Hernandez refused, the victim walked away.

Acosta-Hernandez said the victim said something like “come here” as he walked away, according to the PC statement, causing Acosta-Hernandez to become extremely angry. He said he felt disrespected by their interaction and the victim’s “aggressive manner.” He told police he got his gun from his truck, went after the victim in an alley and shot him about eight times, the PC statement says. The victim later died at the hospital.
