Aurora homeowner shoots man breaking into garage

An Aurora homeowner shot and seriously injured a man found breaking into his detached garage early Monday morning.

According to an Aurora Police Department news release, the shooting occurred at 4:49 a.m. at 1200 Moline Street when the homeowner confronted the suspect and an “altercation ensued.”

Arapahoe County Assessor records show the property is owned by James Gongaware.

Attempts to reach the homeowner for comment were unsuccessful. 

The homeowner reported another break-in on Saturday May 17, when $400 worth of items were stolen. Following that incident he installed cameras in the garage that alerted him to Monday morning’s break-in.

Investigators interviewed the homeowner and released him, according to APD Criminal charges are not expected. Detectives will continue to investigate and will present their findings to the district attorney’s office upon completion.

Colorado has a self-defense law titled Make My Day, which allows homeowners to use deadly force against an intruder. According to Concealed Carry Classes of Denver it’s the “detached garage dilemma.”

Colorado courts have ruled that such an out building, if a dwelling “used or intended for living or sleeping by human occupants” the Make My Day law would apply, according to the Colorado Department of Public Health and Environment.

The suspect is currently hospitalized with life-threatening injuries.
