Colorado joins lawsuit against Trump administration over Planned Parenthood funding

Colorado has joined a coalition of 22 states suing the Trump administration for blocking Planned Parenthood from receiving federal Medicaid funds.

Earlier this month, Congress passed its federal spending bill, which includes a “Defund Provision.” The provision requires the federal government to end Medicaid payments for abortion providers that received more than $800,000 from Medicaid in 2023, including Planned Parenthood, for up to a year.

A nonprofit organization, Planned Parenthood also provides cancer screenings, birth control, and STI testing.

“The Defund Provision cuts Planned Parenthood—an essential health care provider—from Medicaid, leaving many patients without options to receive critical health care services,” the Attorney General’s Office said in announcing the latest lawsuit challenging Trump administration policies. “Coloradans continually have made it clear that they support reproductive health care and we are suing the administration to stop it from implementing the provision and leaving states with higher costs for care in the long-term.”

Cutting funds for Planned Parenthood puts at least 200 health centers and over a million patients at risk nationwide, according to the lawsuit announcement.

Yesterday, a federal judge in Boston ruled that the federal government must continue to reimburse Planned Parenthood for Medicaid funding, concluding that the “Defund Provision” likely violates the First Amendment and Equal Protection Clause by specifically targeting Planned Parenthood’s health centers.

In their filing, the attorneys general argued that the provision violates Congress’ Spending Clause power and is likely to increase health risks and costs to Medicaid programs of over $50 million in the next 10 years.
