DOJ files complaint against Judge Boasberg for undermining ‘integrity’ of judiciary
The Department of Justice filed a misconduct complaint against U.S. District Chief Judge James Boasberg on Monday, alleging he made “improper public comments” about the Trump administration.
“These comments have undermined the integrity of the judiciary, and we will not stand for that,” Attorney General Pam Bondi said in announcing the complaint.
The DOJ complaint refers to Boasberg’s leaked comments in a meeting with other judges during a March 11 gathering of the Judicial Conference, a policymaking body consisting of top federal judges. Boasberg reportedly told fellow judges and Supreme Court Chief Justice John Roberts that his colleagues were “concern[ed] that the Administration would disregard rulings of federal courts leading to a constitutional crisis,” according to a memo reported by the Federalist.
Boasberg has sparred with the Trump administration for months over a court case involving the deportations of alleged Venezuelan gang members to El Salvador.
The federal government argued the deportations were authorized under the Alien Enemies Act, but the Obama-appointed judge issued a temporary restraining order instructing the Trump administration to return airplanes carrying illegal immigrants from Venezuela that were already en route to a notorious prison in El Salvador. Boasberg entered the order after the planes had already departed, and the aircraft was thus not turned around.
That order was issued on March 15, days after his comments to the other judges.
President Donald Trump has been particularly critical of Boasberg, suggesting the federal judge should be impeached over his handling of the deportation case. Now the DOJ is getting involved.
The new complaint alleges Boasberg violated ethical obligations through his public comments and calls for his removal from the case, in addition to disciplinary action. The document suggests Boasberg should be publicly reprimanded or recommended for impeachment amid a pending investigation.

“Swift, visible action will reinforce the judiciary’s institutional integrity by showing that judges are held to the same standards they enforce and deter comparable misconduct,” it states.
DOJ chief of staff Chad Mizelle filed the complaint with the U.S. Court of Appeals for the District of Columbia Circuit Chief Judge Sri Srinivasan, who can dismiss the complaint, conclude that appropriate action has been taken, or appoint a committee to reprimand Boasberg.
